GOMERSAL WINE X BAROSSA PAVILIONS - TERMS & CONDITIONS

  1. The “Promoter” is Gomersal Wines Pty Ltd  (ABN: 11 160 081 729) 203 Lyndoch Road Gomersal SA 5352 - (08) 8563 3611. The “Promotion” is ‘Barossa Pavilions x Gomersal Wines’.

  2. By providing your contact details you subscribe to receive future special offers, promotions plus information about special events from Gomersal Wines, and from our agents, until such time as you request us to stop. Should you wish to opt out at any time simply let us know by phone or email. We will provide you with appropriate contact details every time we contact you. Your details remain yours and may only be shared with our agents for the purposes of communicating Gomersal Wines offers only. They will NOT be sold or rented to any other companies.

  3. The Promoter supports the responsible service of alcohol and encourages consumers to enjoy alcohol responsibly. Entrants will be refused service of alcohol or provision of an alcohol beverage if it would breach any laws, codes or policies including those of the relevant liquor licensee relating to the responsible service of alcohol. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol.   4. Entry is open to all residents of Australia. Employees and their immediate families of the Promoter and their associated agencies and companies are not eligible to enter.

  5. Information on how to enter and all major and runner up prizes form part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, the Promoter, Instagram and their associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the promotion.   12. It is a condition of entry that all entrants are over the age of 18 upon the date of entry.

  13. The Promoter reserves the right to request winners to provide proof of identity, proof of age and, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, age, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

  14. The competition commences on 13th of July 2021 and concludes on 2nd August 2021 at 11:59pm (ACST). Entries must be received by the Promoter prior to the competition close date and time - the time of entry will be the time the online entry is received by Gomersal Wines Pty Ltd.

  15. The Promoter accepts no responsibility for any late, lost or misdirected entries.

  16. The prize draw will occur at 09.00 ACST on 02.08.2021.

  17. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these terms and conditions. For the purposes of these content requirements, “entry content” includes any content (including text, photos, videos and email messages) that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the Promotion. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work.  If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry. An entrant’s entry must not include:

    i) any image of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;

    ii) any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and

    iii) any literary or artistic work, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content (for example, copyright text) they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these terms and conditions.

  18. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

  19. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.

  20. Entrants may enter as many times as they like but only one prize will be awarded per household.

  21. The winners will be the valid entry submitted in accordance with these terms and conditions, that is selected at random by the Gomersal Wines marketing team on 02.08.2021 at 8 The Parade West Kent Town SA 5067.

  22. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result or any other decisions the Promoter makes in connection with the Promotion.

  23. The winners will be notified by Gomersal Wines Pty Ltd via email and/or phone with the contact details provided in the entry form. The promoter will personally notify all prize winners within two days of the draw of prizes. Winners of prizes will be published online at www.gomersalwines.com.au/win-barossa-pavilions-gomersal

  24. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

  25. Total prize pool is valued up to $1275 inc GST. Prize pool includes;
    - 2 night stay for 1 couple in a Deluxe River or Sky Pavilion (midweek stay only, not valid for use during the weekend) (valued up to $940 inc GST)
    -VIP Gomersal Experience: walk through the vines with Barry, 2 x Tasting Flight ($20) regional platter ($45), a mixed Gomersal Wines dozen to take home (2 x 2020 Gomersal Premium Riesling, 2 x 2018 Gomersal Premium GSM, 2 x 2017 Gomersal Premium Cabernet Sauvignon, 2 x 2017 Gomersal Premium Shiraz, 1 x 2017 Gomersal Vintage Fortified Shiraz, 2 x 2016 Gomersal Reserve Shiraz, 1 x 2016 Gomersal Estate Shiraz- valued at $270)

  26. The Promoter will transfer prize winners to and from Gomersal Wines, when redeeming their VIP Gomersal Experience.

  27. The Promoter will directly cover the cost of all prize elements listed in point 25 above. All other costs, other than those specified by the Promoter above as ‘the prize’, shall be paid for by the prize winner.Spending money, additional meals, insurance, transport to and from Barossa Pavilions, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

  28. The winner may be required to present their credit card at time of accommodation check in.

  29. Prize values are based upon the recommended retail prices at the time of publication (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

  30. Prize cannot be transferred, exchanged or redeemed for cash.

  31. Prize must be used by 31st October 2021 - failure to use prize by the date, means the prize is void. It is the responsibility of the winner to redeem and book their prize dates.

  32. Prize is valid midweek (Mon - Thurs), prize not valid for use on Friday, Saturday or Sunday.

  33. Terms and Conditions of Occupancy - the prize winner must follow the following:

    CHECK-IN PROCEDURE: 
    Barossa Pavilions and Glasshouse is located within a secure gated property with private keyless access to accommodation. No reception or permanent staff are located on site. Gate and room entry codes are sent via email on the day before arrival. Guests who do not have access to email should contact us before 12pm on the day of arrival.

    CHECK-IN TIME is from 2:00pm (1400 hours) 
    CHECK-OUT TIME is before 11:00am (1100 hours)

    EARLY ARRIVAL and LATE DEPARTURE (Pavilions Only): With only 6 Pavilions, early check-in or a late check-out is often not possible and can only be confirmed 24 hours prior to arrival or departure. If available, extra staffing costs mean arrivals before 2pm or departures after 11am are charged at $30 per hour…. when booking online you are able to select this option as an extra. We will advise via email the day before arrival or departure if the request is possible and confirm the charge to be applied to your card. This cost is not part of the prize and must be covered by the winner.

    MAXIMUM OCCUPANCY: Each Pavilion can accommodate a maximum of 2 adults. Guests attempting to accommodate more persons than the prize states are forewarned they will turned away, forfeiting the full value of their prize.

    VISITORS: For the privacy and security of all guests, visitors to the property are NOT allowed without the prior approval of management.

    NO EVENTS or PARTIES: Guests at Barossa Pavilions and Glasshouse must not hold any functions, events, parties or wedding related activities on the property without prior approval of management. Charges or penalties may apply.

    NO CHILDREN : Barossa Pavilions and Glasshouse are designed to be a couples retreat and therefore not suitable for children or toddlers. Babes in arms (ie. Infants less than 12 months old) are welcome, however we do not provide cots or high chairs. We are happy to accommodate guests over the age of 10 in the Glasshouse.

    NO PETS: Due to the presence of stock and wildlife on the property pets are not allowed.

    NO SMOKING: Smoking is not permitted inside the Pavilions or Glasshouse. Smoking is allowed outside. Guests should be careful to extinguish butts fully and ensure windows/doors nearby are closed. If smoke is evident inside a building, an additional cleaning/airing charge of $300 will be applicable plus the cost on any room nights from loss of room hire.

    SPA BATH USE: No additives/oils/surfactants other than the products we supply are to be added to the spa bath. If a spray tan or self tan treatment has been applied within the last 24 hours the spa jets should not be used. Oil based products used in tan treatments can cause issues with cleaning/flushing of the spa which in some cases will incur $100 p/hour excess cleaning charge.

    DUE CARE/CLEANLINESS: Although we understand accidents can happen, obvious indiscriminate damage or filth left in a Pavilion or Glasshouse is not acceptable. Evidence of such abuse will result in a $100 p/hour excess cleaning charge along with any applicable replacement/repair costs.

     

  34. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

  35. Prize must be taken within 3 months of winning announcement. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

  36. The promoter is responsible for delivery (within Australia) of the prize to the winners however will not be liable for any damage to or delay in transit of prizes. The promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner however will make all reasonable efforts to deliver prizes to the addresses provided by competition entrants in their entry form. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery.

  37. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

  38. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  39. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission as submitted during the winner’s participation in the prize to appear in connection with the Promoter, or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use. Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

  41. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
